A 19th-century oil painting by Camille Pissarro, once seized by the Nazis from a Jewish family in Paris, has surfaced in an unlikely place: a luxury real estate listing in New York. A federal judge ruled Tuesday that the current owners must surrender the piece, ending a decades-long legal battle over the work’s provenance.

The painting, *La Cueillette* (The Harvest), was forcibly sold in 1943 by Simon Bauer, a prominent French-Jewish art collector. Bauer was arrested by the Vichy regime and later sent to the Drancy internment camp. He managed to survive the Holocaust, but his extensive art collection was scattered across Europe during the occupation.

For years, the painting changed hands through various galleries, eventually landing in the possession of a private collector who listed the property—and the art inside—for sale. When the listing photos hit the web, researchers identified the work. The Bauer family heirs immediately filed a petition to recover the asset, citing the 1943 forced transaction as proof of theft.

The current owners argued they were “good-faith purchasers,” unaware of the painting’s dark history. They claimed they had acquired the work legally in the 1990s through legitimate auction channels.

Judge John Koeltl rejected that defense. Under the 2016 Holocaust Expropriated Art Recovery (HEAR) Act, the court found the original sale was not a voluntary transaction but a product of state-sponsored persecution. The law prioritizes the rights of victims over the claims of subsequent buyers, regardless of whether those buyers knew the history when they paid for the work.

“Provenance isn’t just paperwork; it’s the history of a crime,” said Sarah Epstein, an independent art historian who tracks Nazi-looted assets. “When a work is stolen under duress, the title never truly transfers to the thief, and it certainly doesn’t transfer to the buyer.”

The court’s decision marks a shift in how the international art market handles disputed works. High-end galleries and auction houses are now under increasing pressure to verify the history of every piece they handle, as the window for heirs to claim looted art remains open under the HEAR Act.

For the Bauer family, the ruling is the final chapter in an eighty-year search. The painting is now slated to be returned to the estate, though the court has yet to set a firm date for the transfer. The current owners face the loss of an asset valued at over $1.5 million — a steep price for a failure to check the ledger.
