ISLAMABAD — Pakistan has formally signaled it cannot immediately repatriate a convicted rapist from the UK, with Deputy Prime Minister Ishaq Dar telling British Foreign Secretary David Miliband that no legal framework currently exists to facilitate such a transfer.

The issue stems from the case of a Rochdale-based offender whose presence in the UK has sparked significant public and political outcry. While British authorities have pushed for the individual’s return to face justice or serve his sentence in Pakistan, Islamabad maintains its hands are tied by a lack of an extradition treaty or a specific prisoner-exchange mechanism.

During their recent dialogue, Dar was blunt about the procedural hurdles. He reiterated that without a bilateral agreement governing the repatriation of criminal convicts, the Pakistani government lacks the legal standing to bypass standard protocols.

For the British government, the case represents a growing diplomatic headache. Miliband has faced mounting pressure from domestic constituencies to expedite the removal of foreign-national offenders, particularly those convicted of violent crimes. However, the legal reality remains stagnant.

Legal experts point out that the absence of a formal treaty doesn’t just complicate this specific case—it creates a recurring pattern of diplomatic friction between the two nations. When cases like this arise, they are often handled on an ad-hoc basis, a strategy that rarely yields quick results.

Dar’s position effectively closes the door on a swift resolution. It forces the UK Home Office back to the drawing board, where they must now navigate the slow, often tedious process of individual case litigation rather than relying on a sweeping inter-governmental agreement.

The exchange highlights a broader disconnect between public expectation in Britain and the rigid, treaty-bound reality of international law. Until a formal mechanism is negotiated and ratified, the Rochdale convict will remain in the UK, and the diplomatic stalemate between London and Islamabad is set to continue.
