Pakistan’s Supreme Court has ordered a complete overhaul of how police investigate domestic murders, demanding a “gender-sensitive” approach that accounts for the power imbalances and systemic abuse often ignored by local law enforcement.

The ruling, authored by Justice Mansoor Ali Shah, targets a deep-seated failure in the criminal justice system: the tendency of investigators to view the killing of women within the home as isolated “crimes of passion” or private family disputes. The court made it clear that these cases require a specialized lens to ensure justice isn’t derailed by patriarchal bias.

“Domestic violence is not a private matter; it is a systemic issue,” the court observed. The bench noted that when investigators lack gender sensitivity, they often default to the perpetrator’s narrative — frequently relying on “honor” or “provocation” as excuses to mitigate the gravity of the crime.

The court’s directives are specific. It has called for specialized training for Investigation Officers (IOs) to help them identify the history of coercion and psychological abuse that typically precedes domestic homicides. This isn’t just a suggestion for better paperwork; it’s a requirement to document the “cycle of violence” that leads to a killing.

For years, police have been criticized for failing to secure crime scenes in domestic settings, often allowing family members to “compromise” or tamper with evidence before a formal probe begins. The Supreme Court’s new guidelines aim to shut those loopholes, insisting that the state’s duty to protect citizens applies just as strictly behind closed doors as it does in public spaces.

The judgment also took aim at the lower courts. It warned that judges must be vigilant against “gender-based myths” that often creep into legal proceedings, such as questioning a victim’s character to justify a defendant’s violent outburst.

This ruling effectively signals the end of the “private matter” defense. By forcing the state to recognize the specific dynamics of domestic terror, the Supreme Court is pushing the legal system to see these victims not as statistics of family tragedy, but as targets of a specific, preventable type of violence.

The message to the police is now blunt: investigate the motive, not the “honor,” or risk the case collapsing under the weight of its own bias.
