Billionaire Elon Musk heads into courtroom clash with OpenAI as trial begins in Oakland

Elon Musk and OpenAI are set to face off in federal court in Oakland in a closely watched trial that could shape not just the future of one company, but the wider argument over who gets to control powerful AI systems and for what purpose. Jury selection is scheduled to begin on Monday, April 27, 2026, with opening arguments expected the following day.

At the center of the case is Musk’s claim that OpenAI, the organization he helped launch in 2015, drifted away from its founding mission as a nonprofit built to develop artificial intelligence for humanity’s benefit. He argues that the company’s evolution into a commercially aggressive powerhouse, closely tied to Microsoft and competing at the top of the AI market, amounts to a betrayal of that original promise.

OpenAI, unsurprisingly, sees it very differently. The company has said Musk’s lawsuit is less about principle than rivalry, arguing that he is trying to slow down a major competitor while building up xAI, his own AI venture and the maker of the Grok chatbot. In public statements and court filings, OpenAI has portrayed the case as a self-interested attempt to interfere with its business rather than a genuine effort to protect its founding ideals.

The case has narrowed just as trial is about to start. On April 24, 2026, U.S. District Judge Yvonne Gonzalez Rogers dismissed Musk’s fraud claims at his own request, leaving the trial to proceed on his claims for breach of charitable trust and unjust enrichment. That trims some of the legal sprawl, but not the drama. The fight still goes straight to the question that has hovered over OpenAI for years: can an organization born as a mission-driven nonprofit become a giant commercial force without abandoning the very thing that made people trust it in the first place?

This showdown did not come out of nowhere. In March 2025, the same judge refused Musk’s request for a preliminary injunction that would have paused OpenAI’s shift toward a for-profit structure, saying he had not met the high bar required for that kind of emergency relief. Even so, she agreed to fast-track the dispute toward trial, signaling that the underlying claims were serious enough to be tested in court rather than brushed aside.

Musk has also tried to blunt one likely criticism of his case — that he is pursuing a personal windfall. In recent filings and public reporting around the trial, he has said he would not keep any damages for himself, and that any monetary recovery should instead go to OpenAI’s charitable arm. It is a notable political and legal gesture, though one that does not erase the obvious business backdrop: Musk is now fighting a company he once funded and now competes against.

That rivalry matters because OpenAI is no longer a quirky research lab. It is one of the most influential companies in tech, propelled by ChatGPT and by the broader generative AI boom. So the trial is not just about old emails, boardroom promises, or personal fallout between Musk and Sam Altman. It is about whether the original nonprofit vision still has legal force when billions of dollars, investor expectations, and global AI leadership are all on the table.

Expect the courtroom to be packed with more than legal arguments. The proceedings are likely to reopen years of Silicon Valley infighting, expose internal communications, and drag some awkward history back into public view. Musk and Altman have spent years sparring in public and in court, but now that fight moves into a setting where claims have to be proven, not just posted. And that, frankly, is what makes this trial different.

Why this case matters

If Musk persuades the jury that OpenAI violated obligations tied to its charitable purpose, the consequences could reach far beyond one lawsuit. A ruling in his favor could complicate how AI labs structure themselves, how nonprofits partner with investors, and how founders frame public-interest missions when huge commercial opportunities emerge later. If OpenAI wins, it will strengthen the argument that mission-driven tech groups can evolve into something far more commercial without necessarily crossing a legal line.

Either way, the Oakland trial is shaping up as one of the most consequential legal fights yet in the AI era — messy, personal, and loaded with implications for the industry that now claims it is building the future.
