The U.S. government has deported an Afghan woman in the first successful application of the Alien Terrorist Removal Court (ATRC), a secretive judicial body established nearly three decades ago. The move marks a shift in how federal authorities handle non-citizens accused of ties to extremist groups, bypassing traditional criminal proceedings in favor of a specialized, classified process.

The woman, whose identity remains protected by court orders, was removed from the country following proceedings that unfolded almost entirely outside the public eye. While the Department of Justice has historically utilized the ATRC sparingly—or not at all—this case signals a new willingness to leverage the court to expedite the removal of individuals deemed a national security threat.

The ATRC was created under the Antiterrorism and Effective Death Penalty Act of 1996. It was designed to allow the government to present classified evidence to a judge without disclosing that information to the defendant or their counsel. Critics have long argued that this structure creates a fundamental imbalance, stripping defendants of their right to confront the evidence against them—a cornerstone of the American legal system.

The case against the Afghan national centered on alleged connections to extremist networks. Because the government relied on classified intelligence, the public record offers little insight into the specific evidence that prompted the deportation. Attorneys involved in the case faced severe restrictions on how they could handle the files, effectively limiting their ability to craft a defense.

Civil liberties groups are already pointing to this deportation as a dangerous precedent. By utilizing a court that operates behind a veil of secrecy, the government avoids the evidentiary hurdles required in federal criminal court. For those facing these proceedings, the path to contesting the government’s claims is narrow, and the outcome is rarely in their favor.

The Department of Justice declined to provide specific details regarding the woman’s current location or the logistics of her transfer. For now, the administration’s successful use of the ATRC serves as a quiet warning that federal authorities have a new, highly effective tool to bypass traditional courtroom transparency in the name of national security.
